Delhi Liquor Scam: Kejriwal’s Political Future; Out of Jail, But Locked Out of Power

Delhi Chief Minister Arvind Kejriwal, once known for his anti-corruption crusades, now faces allegations in a corruption case related to the Delhi liquor policy scam. Like Rahul and Sonia Gandhi, Kejriwal is currently out on bail, marking a notable moment in Indian politics. However, the Supreme Court’s decision to grant him bail comes with stringent conditions, effectively leaving him a Chief Minister in name only, with almost no power or authority. This situation raises critical questions about governance, Kejriwal’s political strategy, and the future direction of the Aam Aadmi Party (AAP).

Kejriwal’s Bail: A Hollow Victory?

On the surface, Kejriwal’s bail might seem like a relief for the Delhi Chief Minister. After days in jail, he is out on bond. However, the conditions imposed by the Supreme Court drastically limit his role and influence. He has been barred from entering the Chief Minister’s office and the Delhi Secretariat, two places essential for governing. Moreover, Kejriwal cannot sign any government files or make decisions, leaving his role effectively ceremonial.

The Court’s decision also forbids Kejriwal from making any public statements regarding his case or his involvement in the Delhi liquor policy scam. He is not allowed to contact any witnesses or intervene in any investigation, and he must present himself in court if required. The restrictions placed on Kejriwal create a political paradox — he holds the title of Chief Minister, but without the ability to execute any of the associated responsibilities.

Why Hasn’t Kejriwal Resigned?

One of the most pressing questions following the Supreme Court’s ruling is: why hasn’t Kejriwal resigned? As Chief Minister, he is effectively stripped of the powers necessary to govern Delhi. In any democratic system, a leader who is unable to fulfill their duties is expected to step down. Kejriwal, however, remains defiant, holding on to his position even though he cannot carry out the functions of his office.

This has drawn criticism from political opponents and commentators alike. Kejriwal, who built his political career on a platform of transparency and integrity, once demanded the resignation of ministers and politicians at the mere hint of allegations. Now, under the weight of his own scandal, he refuses to leave office. His critics accuse him of clinging to power at all costs, even as his administration is paralyzed by legal constraints.

The Impact on Delhi Governance

With Kejriwal sidelined from governance, the pressing question is: who is truly in charge of Delhi? The administration is in a state of uncertainty, as Kejriwal is unable to sign files, convene cabinet meetings, or make key decisions. While AAP leaders may handle day-to-day operations, the lack of clear leadership raises serious concerns about the effectiveness and efficiency of the government. Basic functions like governance, decision-making, and policy implementation are at risk of suffering in the coming weeks.

Kejriwal, in many ways, mirrors Dhritarashtra from the Mahabharata—holding the throne yet devoid of the power to act, a leader in name only. This situation of having symbolic power without real authority casts a long shadow over his leadership and the future governance of Delhi. This situation is unprecedented in Indian politics. It is rare for a sitting Chief Minister to retain office while being so comprehensively sidelined by the judiciary. In the long term, it could set a troubling precedent, where political figures cling to power despite being effectively incapacitated by legal issues, raising new questions about accountability and governance in India’s democracy.

Kejriwal’s Future in Politics: A Paradox

The Supreme Court’s ruling has left Kejriwal in a unique position — he remains the Chief Minister of Delhi, but with no real authority. The question of his political future now hangs in the balance. Kejriwal’s ability to lead his party and maintain public confidence will depend on how he navigates this challenging period. His political image, once that of an anti-corruption crusader, is now marred by allegations of wrongdoing in the liquor policy case.

However, the restrictions imposed by the court do not prevent Kejriwal from engaging in political campaigning, particularly in the upcoming Haryana elections. This opens up another significant dilemma for his party and the opposition alliance he is part of. Kejriwal’s Aam Aadmi Party (AAP) is currently aligned with Congress in the opposition front, but in Haryana, they are direct competitors. If AAP splits the anti-BJP vote in the state, it could inadvertently benefit the ruling Bharatiya Janata Party (BJP), much like in past elections.

The Haryana Elections: A Divided Opposition

The upcoming Haryana elections are another significant battleground for Kejriwal and AAP. His ability to campaign is not restricted by the Supreme Court, and he is expected to play a prominent role in the AAP’s election strategy. However, the electoral dynamics in Haryana are complex. AAP, which is contesting all 90 seats in the state, may end up splitting the anti-BJP vote. This could benefit the BJP by dividing votes between Congress, AAP, and smaller regional parties like the Indian National Lok Dal (INLD) and Bahujan Samaj Party (BSP).

In the last Haryana assembly election, a similar scenario unfolded. The BJP won the election largely because the anti-BJP vote was split between Congress, Jannayak Janata Party (JJP), and Indian National Lok Dal (INLD). This time, with AAP entering the fray and contesting all seats, the opposition is even more divided. Congress, which was a strong contender in Haryana, now faces a multi-cornered fight, making it harder to secure a majority. A divided opposition could once again pave the way for the BJP to retain power.

Kejriwal’s Alliance with Congress: A Double-Edged Sword

While AAP and Congress are allies at the national level, the two parties are rivals in Haryana. This creates a complicated political scenario where both parties must balance national cooperation with local competition. Congress leaders are understandably wary of AAP’s influence in Haryana, as even a small percentage of vote share going to AAP could tip the scales in favor of the BJP. This puts Kejriwal in a tricky position — he must campaign aggressively to build AAP’s presence in Haryana while not appearing to undermine the opposition alliance with Congress.

Adding to the complexity is the perception that Kejriwal’s legal troubles could weaken the opposition’s case against the BJP. As long as he remains embroiled in corruption allegations, it becomes harder for AAP to present itself as a clean, anti-corruption alternative to the BJP. This may also dampen the enthusiasm of voters who once saw AAP as a party of transparency and integrity.

A Weakening of India’s Democracy?

Kejriwal’s case has broader implications for Indian democracy. His refusal to resign despite being unable to perform his duties, combined with the Supreme Court’s decision to allow him to remain Chief Minister without power, reflects a deeper malaise in Indian politics. This episode raises concerns about accountability, the rule of law, and the strength of India’s democratic institutions.

Kejriwal, once a symbol of the fight against corruption, now stands as a cautionary tale of the corrupting influence of power. Whether he emerges from this crisis with his political reputation intact remains to be seen, but the immediate impact on governance in Delhi and the opposition’s prospects in Haryana are undeniable.

As the 2024 election season unfolds, Arvind Kejriwal’s political future and leadership are under intense scrutiny. The corruption case linked to the Delhi liquor policy, along with the stringent restrictions imposed by the Supreme Court, have thrown his role as Chief Minister into question. Though he retains the title, his authority has been significantly curtailed, leading to a period of governance uncertainty in Delhi.
