The Allegations:

According to the FIR, On May 13, 2024, at around 9 am, Swati Maliwal went to meet Chief Minister Arvind Kejriwal at his residence located at 6th Flag Staff Road, Civil Lines, Delhi. She was asked to wait in the drawing room, where she was later confronted by Bibhav Kumar. Without any provocation, Kumar allegedly started verbally abusing Maliwal and physically assaulted her. The FIR states that Kumar slapped her multiple times, causing her to fall and hit her head on a table. Maliwal claims that she pleaded for help, but no one came to her aid. The assault reportedly continued, with Kumar kicking her in the chest, stomach, and pelvis area even after her plea that she was on Menstrual cycle. . She also mentions that her clothes were torn during the incident. As per the FIR details, Bibhav Kumar threatened by saying, ‘will bury you, no one will ever know’. Maliwal managed to escape and called the police to report the crime. Even after the alleged criminal act Bibhav Kumar was found to be accompanying the Delhi CM during his election rally in Lucknow yesterday.

The Shocking Nature of the Incident:

The allegations made by Maliwal are deeply disturbing. The FIR suggests that Kejriwal’s personal assistant physically assaulted her, disregarding her pleas for help. Maliwal’s statement in the FIR highlights the severity of the incident, with details of the assault and the pain she endured. The fact that she was a former colleague and friend of Kejriwal makes the situation even more shocking.

Maliwal’s Actions:

After the assault, Maliwal immediately called the police helpline number, 112, to report the incident. She then went to the Civil Lines police station to file a complaint. In her written complaint, Maliwal described the extent of her injuries, including severe pain in her head, neck, arms, and stomach. She also mentioned that she was menstruating at the time of the assault, which caused additional pain. Maliwal expressed her shock and disbelief that such an incident could occur within the Chief Minister’s residence. She was found to be still in the state of shock.

Legal Proceedings:

The Delhi Police have registered a First Information Report (FIR) based on Maliwal’s complaint. The charges against Vibhav Kumar include assault and sexual harassment under relevant sections of the Indian Penal Code. The police have also invoked IPC Section 308, which pertains to an attempt to commit culpable homicide not amounting to murder. Other Sections of IPC 354, 506/507, 509 has been invoked This indicates the seriousness of the allegations made by Maliwal. All these are non-Bali-able offence

Investigation and Interrogation:

The Delhi Police will conduct a thorough investigation into the incident. They will collect CCTV footage from the Chief Minister’s residence and interview the staff present at the time of the incident. Swati Maliwal’s statement will be recorded under Section 164 of the Criminal Procedure Code (CrPC) in the presence of a magistrate. The police will also interrogate Chief Minister Arvind Kejriwal regarding his knowledge of the incident and his actions during and after the assault. Police is making an effort to seize the CCTV footage at Delhi CM residence. Bibhav Kumar is currently being sought by the police, and efforts are being made to locate him.

Political Response:

The Aam Aadmi Party has faced criticism for its handling of the matter. It is alleged that the party attempted to suppress the incident and dissuade Maliwal from filing a police complaint. Sanjay Singh, a senior party member, met with Maliwal multiple times, raising questions about the party’s involvement. Chief Minister Arvind Kejriwal has not yet addressed the allegations publicly, leading to further scrutiny.
